taiko electronics operated. in exchange they will give the city more than a million dollars ove 10 years, not including the $200,000 facebook will pay in property taxes each year. a 13-year-old girl fights off a kidnapper in san jose and escapes. this man tried to grab the teen on 33rd and saint james streets last friday morning. a neighbor's home surveillance video caught the struggle. you can see the victim right there wearing white. she gets snatched from behind and dragged into a dark driveway. police say the girl started screaming and put up a good fight. 14 seconds later she breaks free and ends up running down the street. neighbors like manuel alvez came out. he even got in his car to look for the suspect. >> it wouldn't have been a pretty sight. i would have had do what i had to do and turn him in to the authorities. >> he said he missed the suspect by about a minute. brentwood union school district is under fire for

standing behind an abusive teacher. dina holder was convicted of kicking an autistic child two years ago. after it was reported, the district moved her to another school. earlier this month, the district settled with the family of the victim for nearly a million dollars and removed holder from her teaching position. last night parents lashed out at the board for allowing holder to teach. >> i don't care what's written down in a procedures manual or anything like that. i think that somebody should have took a stand and said, we need to get her away from kids. >> district officials say it's difficult to fire tenured teachers. as part of the settlement, holder is now on paid administrative leave and will resign at the end of the school year. since holder was only charged with a misdemeanor, she can teach if another district hires her. later this morning we'll get the governor's take on how things are going here in california. jerry brown will deliver his

state of the state address to the legislature. he is expected to tell his fellow democrats who control the senate and assembly that an improving budget situation does not mean they can go on a spending spree. in a surprising move, the pentagon announced it will lift its ban and allow women to be sent to the front lines. senior defense officials say defense secretary leon panetta will change the rules today that will allow women to serve in patrol and commando roles. the military services will have until 2016 to allow women to join combat positions. tough questions for secretary of state hillary clinton on the attack on the u.s. consulate in benghazi. the senate and house foreign relations committees grilled her for more than five hours yesterday. clinton was accused of not doing enough to provide protection and of misleading the public in the aftermath of four americans being killed. the secretary responded to say she is focused on trying to fix

what went wrong. and secretary clinton's replacement will begin his nomination process today. senator john kerry will go before the senate foreign relations committee in the first step to become the next secretary of state. to prepare for his new role, the senator will have to sell off many of his personal investments in order to avoid possible conflicts of interest. kerry is the senate's richest member with a estimated net worth of more than $184 million. 4:36 now. today california senator plans to introduce a bill to ban assault weapons in the united states. cbs reporter susan mcginnis says the move will set the stage for a debate over gun control. >> freedom! >> reporter: the fight over gun control moves from the streets to the halls of congress today. senator dianne feinstein of california will introduce a bill banning assault weapons and high capacity ammunition clips. >> you need to do something about the guns. >> reporter: connecticut senators richard blumenthal and

chris murphy are cosponsoring the bill. they say the shooting at sandy hook elementary school in newtown, connecticut proves there is a need to ban assault weapons. >> newtown fundamentally changed things. >> reporter: but the nra says law-abiding citizens need the same technology the criminals have. >> that means we believe in our right to defend ourselves and our families with semi- automatic firearms technology. >> reporter: the nra has a lot of support here on capitol hill especially in the house where many say an assault weapons ban has little chance of being passed. >> this is going to be a tough go. >> reporter: and it may be tough to win over some of the public, as well. on wednesday, sheriffs in missouri, california and texas announced they would not enforce new gun control laws such as an assault weapons ban. >> if there are laws passed that i feel and can prove that are unconstitutional, we will not enforce those rules and i think i have the powers to do

including across the dumbarton bridge. in the meantime, back to you guys. a man dies trying to cross a freeway on-ramp in oakland last night just before 9 p.m. on the 17th street on-ramp to westbound interstate 980. the highway patrol says the elderly victim was hit by three cars. two drivers left the scene but one is cooperating with investigators. the chp says the pedestrian may have been homeless. he was pronounced dead at the scene. oakland police have detained two people in connection with a fire in a vacant victorian on harrison street. the two were actually rescued from the roof of that burning house yesterday. according to the owner, the vacant property is known to house squatters. it took firefighters to put it out. a $26 million security system is approved for the new eastern span of the bay bridge. the system will include 175 video, infrared and thermal imaging cameras. equipment will be atop the bridge and beneath it and will include a monitoring system.

this is now. the dona spring animal shelter opened in november and with it came an unfamiliar sound almost nothing. the kennels are separated by soundproof plexiglass and what a difference that has made. >> as you can see most of them are quiet and sleeping. in the other please for eight hours a day they were barking at each other and at us. >> reporter: now the animals are calmer and more sociable. they enjoy the view out the window watching the birds at nearby aquatic park. >> hi, girl. >> reporter: even cranky old blanche has decided it's not so bad to be around people. and it's healthier here, too. because each pen has separate ventilation, there have been no outbreaks of kennel cough or ringworm which plague most shelters. >> or if we were to get an outbreak of something like pavo virus in this room we can close this room down while the rest of the shelter is still functioning. >> reporter: there is a clinic with operating room and full- time vet tech. animals that used to be trucked

out for expensive private vet care can be treated here at home. >> it's wonderful on so many levels. it's good for the staff and in turn great for the animals and in turn great for the community records but no one is happier than greta. she came here missing part of a leg. the staff fitted her with a brand-new prosthetic. it will take a few months to get used to it but that's not going to slow her down a bit as she waits for a new home. >> with animals like greta and the other animals that are here, the best we can do for them is a facility like this which does restore one's faith that society can spend money correctly. >> reporter: in berkeley, john ramos, cbs 5. if your super bowl menu includes chicken wings, stock up now. last year's drought means corn prices are at an all-time high and chickens eat corn so chicken prices are up. as a result, farmers are producing fewer chickens and wings, which use to be the
